New general limitation period for civil claims – Polish Civil Code amended

Today the latest amendment to the Polish Civil Code comes into force (text: ISAP), which is primarily aimed at reducing the current period under the statute of limitations for claims from ten to six years.

The period of limitation specified for claims for regularly provided services and business-related claims will continue to be three years. The act also introduces changes that are important from the point of view of consumer interests. Here the statute amends the previous regulation on limitation periods with respect to the consumer goods as a result of the judgement of the Court of Justice of the European Union in case C‑133/16 issued on 13 July 2017 (text: CURIA).

The reduction of the generally applicable period of limitation of claims will certainly require greater discipline on the part of parties to a legal relationship. It can also be expected that there will be less difficulties in relation to evidence when determining the limitation period, and it will thus minimise uncertainty as to whether they are actionable.
