Cross-border infringements of competition law – applicable law

Effects of unfair or monopolistic business practices frequently extend across more than one country. With ever closer links between businesses and customers in the EU’s internal market, it is necessary to predict and respond to cross-border actions of competitors. This is where an appropriate tool is provided by the Regulation (EC) No 864/2007 of the European Parliament and of the Council of 11 July 2007 on the law applicable to non-contractual obligations (Rome II, see in EUR-Lex).
